TERMS OF TRADE

The following are Terms of Trade and Guarantee applicable to all orders accepted by Doors Delivered or its agents from customers for the purchase of goods or provision of services in relation to the goods.

Doors Delivered will refund any door purchased with 48-hour period of delivery providing the door is still in its original packaging.

Hardware only orders are non-refundable unless Doors Delivered fails to deliver the products to industry standard within a reasonable timescale, generally 1-2 weeks from receipt of payment for stock items or at such time as mutually agreed between Doors Delivered and the customer.

All goods and services provided by Doors Delivered are provided upon terms contained below.

It is the customers’ responsibility, upon delivery of any goods to ensure that they perform and meet the customers’ requirements; Doors Delivered will ensure all products meet industry standards and are fit for use.

Doors Delivered will not be liable for any costs, claims, damages or demands arising from personal injury, loss or damage whatsoever or howsoever occurring to the customer or its servants or agents as result of any act or omission of the customer or Doors Delivered and in no case shall Doors Delivered be liable for any consequential loss or damage, unless such injury, loss or damage is a result of a fault in the product.

The Terms of Trade and Warranty and the agreement incorporating them shall be governed by and construed in accordance with the laws of Western Australia.

GENERAL LEGAL RIGHTS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.  You are entitled to a replacement or refund for a major failure or for compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.  The benefits under our guarantee are in addition to other rights and remedies under a law in relation to the goods.

DOORS DELIVERED GUARANTEE

Subject to terms and conditions set forth herein, products manufactured and branded by Doors Delivered, are guaranteed from the date of shipment, for 5 years, to be of good material and workmanship, free from defects which may render them unserviceable or unfit for the use for which they were manufactured.

Doors Delivered guarantees against faulty materials or workmanship are for the sole benefit of the original purchaser. They are not transferable. All claims must be supported by original proof of purchase.  General wear and tear, including damage caused by lack of maintenance or extreme weather conditions will not be covered under this guarantee.

Non-Doors Delivered branded products are covered by the manufacturers’ warranty applicable at the time of purchase.

Doors must be stored in dry buildings and not in damp, moist or freshly plastered areas. Doors must bestoredlaid down flat on an even surface and not directly on concrete floors.

All entrance and solid doors up to 2134 x 1014mm must be hung on three 100mm x 75mm hinges to help prevent the door from warping.

All entrance and solid doors over 2134 x 1014mm must be hung on four 100mm x 75mm hinges.

All doors can be trimmed to a maximum of 10mm from any edge.

Any scratches or marks on glass not visible from 1000mm away are not considered a defect. Glass defects must be reported to Doors Delivered within 7 days of delivery.

Any warp not exceeding 5mm on doors up to 2134mm x 914mm and 6mm on doors over 2134 x 914mm and up to 2438mm x 1219mm are not considered defects.  Doors in excess of this height are not guaranteed against warping unless under special terms advised by Doors Delivered.  Doors Delivered will not accept responsibility for conditions wholly beyond its control. However, Doors Delivered should be consulted promptly if excessive warping occurs to provide assistance overcoming the difficulty.

PAINTING & STAINING

After installation the doors must be sealed with external paint or stain. Gloss enamel paint must be used on entrance doors, acrylic may be used on internal doors only. Preparation, such as filling pin holes in glazing beads, sanding etc. is the responsibility of the painter and should be done prior to applying the first coat. Any perceived defects must be notified to Doors Delivered BEFORE painting or staining commences.

Doors must be sealed on both faces and all four edges including beneath weather trims/seals with at least 3 coats. Timber doors must be kept dry prior to sealing / finishing and not left raw for more than 48 hours after installation. During periods of damp or wet weather it is the customer’s responsibility to protect timber doors before they are properly sealed.  Doors Delivered will not be held responsible for damage caused to timber products as a result of failure by the customer to protect doors in such circumstances.

If staining, an exterior grade product specifically for external doors must be used, its application to be equivalent to a gloss enamel paint finish to prevent absorption of moisture or the timber drying out below 10% moisture content.  UV stable products must be used in areas exposed to direct sunlight to prevent colour leaching from timber.

Doors exposed to direct sunlight must be painted in light reflective colours to reduce heat absorption; which could cause warping.  Failure to adhere to this condition may void your warranty.

All Doors must be hung with overhead protection, and doors hung in fully exposed areas with no overhead protection will not be warranted.  Periodic maintenance to timber door finishing will be required to ensure paint, stain or varnish breakdown does not allow the door to be damaged by the weather.  Damage to doors caused by breakdown of paint or stain finish is not covered by warranty.

Variations in the colour, texture or grain pattern are not considered defects in timber, these are natural products and will have significant variation in colour and grain.

Small shakes or hairline cracks can occur in timber products over time.  These do not affect the structural integrity of the product and are not consider a defect unless a split opens up or a crack travels through the thickness of the door. The company will accept no responsibility for doors where moisture content of the timber falls below 10% or exceeds 18%. Doors Delivered reserves the right to repair or replace faulty or damaged items at its discretion.  This does not affect the balance of your warranty.

Doors Delivered will not be held responsible for additional charges, including painting or staining, arising from the replacement of doors.

HARDWARE

Non-Doors Delivered branded products are covered by the manufacturers’ guarantee applicable at the time of purchase. Refer to manufacturers’ terms & conditions for more information.  Locks and handles, hinges and other hardware products must be cleaned regularly to prevent build-up of salt and dirt deposits that could cause tea staining and, ultimately, corrosion. Failure to do this may affect the warranty of these products.

DELIVERY TERMS AND CONDITIONS

The following terms and conditions will apply between Doors Delivered and “you”, for the delivery of Doors and hardware purchased from Doors Delivered which Doors Delivered has agreed to deliver (the “Goods”) to premises specified by you (“Premises”).

Doors Delivered will endeavour to deliver the Goods on the day agreed with you. Doors Delivered does not offer set delivery times. Please note that delivery may be affected by factors outside of Doors Delivered’ control, such as adverse weather conditions, traffic conditions and the actions of the delivery agent, and Doors Delivered therefore cannot guarantee delivery at the prearranged time and day. Where this happens, Doors Delivered will provide you with as much notice as practical and will arrange another delivery day with you. If you are not sure of your likely delivery time or day, please contact Doors Delivered.

You must provide at least 24 hours’ notice if you wish to change the delivery day that you have agreed with Doors Delivered, by using the contact method you have been given. If, on arrival, the Premises are unattended Doors Delivered will wait 15 minutes, and if still unattended, will then leave. Where this happens, we will send you an SMS so another delivery day can be scheduled which may take up to 48hrs. If you do not provide this notice, Doors Delivered reserves the right to charge you its reasonable costs of any failed delivery and for rearranging the delivery.

You, or another person over the age of 18 whom you have given authority to accept delivery of the Goods, must be present at the time of delivery. Any reference to “you” in the paragraphs below includes any such person.

You must ensure that the delivery vehicle can park immediately outside the entrance to the Premises, allowing for a van measuring up to 6 metres long to park. Doors Delivered reserves the right to refuse to deliver where it is unable to park within 20 metres of the entrance to the Premises. Any applicable parking charges are your responsibility.

You must ensure that any pets are placed in a secure location before delivery commences and at all times during the Delivery Process. The term “Delivery Process” includes the process for delivering the Goods.

Doors Delivered will take reasonable care but cannot guarantee that floors or walls will not get dirty, wet, or incur minor scuffing or minor indentations during the Delivery Process. Doors Delivered suggests that you cover floors or walls to protect them.

You are responsible for ensuring that the route(s) from the boundary of the Premises to the specific delivery location is of sufficient size, safe and clear of obstacles. If the Goods cannot be delivered to the specific delivery location for any of these reasons, then Doors Delivered reserves the right to charge you its reasonable costs of any failed delivery and for re-arranging the delivery. In particular, please bear in mind the weight of the Goods to be delivered and whether the floors and stairs/steps are strong enough for the load and whether tiles or other floor coverings or materials could be damaged as a result of this weight. Save as otherwise provided by the consumer guarantees under the Australian Consumer Law, Doors Delivered shall not be responsible for any loss, cost, damage, expense, injury, or death arising from the structure, fixtures or fittings of the Premises being unable to bear the weight of the Goods.

Upon arrival at the Premises, you must ensure that Doors Delivered can commence all relevant tasks without delay. The delivery person will inspect the location(s) and the route from the delivery vehicle to that/those location(s). In the event that the delivery person believes that the route to a location or the location itself is unsafe or impractical for the goods in standard packaging they will be unable to perform the delivery to or from that location and will: (a) in the case of delivery, deliver the Goods to such other location inside or outside the Premises as you direct, provided they consider this location and the route to this location to be safe and practical.

If the delivery person notices any pre-existing damage on the proposed delivery/removal route within your Premises before they deliver/remove the Goods they will bring this to your attention. This is intended to avoid any dispute as to whether the delivery person has caused any damage to your Premises during the delivery process. The delivery person may make notes about such damage and may also take photographs.

Delivery is only possible to ground floors, Doors Delivered is not able to deliver up flights of stairs or lifts.

Risk of loss, damage or theft to the Goods passes to you at the time of delivery of the Goods to the Premises.

At the end of the Delivery Process, you will be required to sign a proof of delivery which will confirm that the Goods have been delivered and will document any noticeable damage to the Goods occurring prior to, or during, the Delivery Process. It will also allow the delivery person to document any damage to your Premises that you believe has been caused during delivery. We may photograph Goods, the location the Goods have been placed in or any damage that you allege has been caused during Delivery.

Doors Delivered strongly advises that both you and the delivery person thoroughly inspect the Goods for physical damage. Any physical damage discovered during such inspection should be noted on the Proof of Delivery. If you wish you can refuse to accept the Goods if there is physical damage to the Goods. If the Goods are not unpacked during delivery, or in the presence of The Doors Delivered’ delivery agent, it will be difficult to establish whether any physical damage to the Goods was caused before or during the Delivery Process, rather than after delivery. If you do notice any physical damage after the Delivery Process is completed, please call customer service.

You acknowledge and agree that if you fail to provide any information, fail to provide correct information or fail to perform any of your obligations under these Terms and Conditions in respect of the Premises or in connection with the Goods, then Doors Delivered, without limiting any of Doors Delivered rights at law refuse to deliver the Goods and/or may require the payment of extra fees from you as reasonably required to perform the delivery.

Nothing contained in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy or other obligation implied by the Australian Consumer Law which cannot by law be excluded, restricted or modified.
